Kazakhstan to investigate disclosure of personal data

The Ministry of Digital Development, Innovation and Aerospace Industry of Kazakhstan will conduct inspections on the facts of violation of citizens' rights in relation to their personal data. Appeals should contain sufficient data indicating signs of an administrative offense: these are supporting materials, information about the subject of the offense and the timing of its commission. Anonymous appeals will not be considered.

The ministry, in turn, will open an audit against the offender. Each audit is registered with the Committee on Legal Statistics and Special Accounts of the Prosecutor General's Office of the Republic of Kazakhstan and is carried out in accordance with the Business Code of the Republic of Kazakhstan and the Administrative Code of the Republic of Kazakhstan in order to protect the rights of entrepreneurs. If the fact is confirmed, a decision will be made to impose an administrative penalty.

At the same time, the authorized body has the right to initiate an administrative case without conducting an audit against small businesses, despite the current moratorium on unscheduled MB inspections until January 1, 2023. The main thing is that all the necessary materials confirming the fact of the offense are provided.

Recall that in June of this year, the Head of State signed the Law "On Amendments and Additions to Some Legislative Acts of the Republic of Kazakhstan on the Regulation of Digital Technologies," which was determined by the Ministry as an authorized body in the field of personal data protection.
